1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the website located at https://myfaciallady.com (the "Site"), and your purchase of products or booking of services from Skin Deep Esthetics and Wellness LLC ("Skin Deep," "we," "us," or "our"). By accessing the Site, booking an appointment, or purchasing a product, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

Our Privacy Policy and Return Policy are incorporated into these Terms by reference. If there is a conflict between this document and the Return Policy on the specific subject of product returns, the Return Policy controls.

2. Who We Are

Skin Deep Esthetics and Wellness LLC is a Utah limited liability company providing esthetics and skincare services and retail skincare products, located at:

3. Eligibility

You must be at least 18 years old to book a service or make a purchase on the Site. Clients under 18 may only receive services with the written or verbal consent of, and in the presence of, a parent or legal guardian. We reserve the right to decline service to a minor without accompanying parental/guardian consent.

4. Booking, Scheduling, and Cancellations

4.1 Booking

Appointments are booked through our scheduling platform, Acuity Scheduling. You are responsible for providing accurate contact and intake information at the time of booking.

4.2 Cancellation and No-Show Policy

We require at least 24 hours' notice to cancel or reschedule an appointment.

  • Late cancellations (less than 24 hours' notice) are subject to a fee of 50% of the scheduled service price.
  • No-shows — including failing to cancel and failing to arrive — are subject to a fee of 100% of the scheduled service price.

This fee will be charged to the payment method on file, where available, or invoiced separately. We reserve the right to waive this fee at our discretion (for example, in the case of a documented emergency).

4.3 Late Arrivals

Please arrive on time for your appointment. Arriving more than 15 minutes late will be treated as a no-show, subject to the 100% fee described in Section 4.2, at our discretion. Clients with a pattern of repeated lateness, late cancellations, or no-shows may be required to prepay for future appointments, or may be declined future bookings altogether.

4.4 Our Right to Cancel or Reschedule

We may cancel or reschedule an appointment due to illness, emergency, or other unforeseen circumstances. We will make reasonable efforts to notify you as soon as possible and to reschedule at no additional cost to you.

5. Health Disclosures, Contraindications, and Right to Refuse Service

5.1 Accuracy of Intake Information

You agree to provide complete and accurate information on our intake forms regarding your skin condition, allergies, medications, pregnancy status, and any other information relevant to the safe provision of services. Failure to disclose accurate or complete information may result in adverse reactions for which Skin Deep is not responsible, and may void any assumption of liability described in Section 6.

5.2 Not Medical Advice

Our services and product recommendations are for general skincare and cosmetic purposes only. We are not physicians, and nothing we say or provide is medical advice, diagnosis, or treatment. If you have a medical condition or are taking medication that could interact with a treatment, consult your physician before booking.

5.3 Right to Refuse or Modify Service

We reserve the right to refuse, modify, or discontinue a service at any time, before or during an appointment, if we reasonably believe the service poses a health or safety risk to you, based on your intake information, visible skin condition, or other factors. This may include, without limitation, declining certain treatments for clients who are pregnant, have active skin infections, or disclose relevant contraindications.

6. Assumption of Risk and Release of Liability

Esthetics services (including but not limited to facials, chemical peels, microdermabrasion, extractions, and related treatments) carry inherent risks, including but not limited to temporary redness, irritation, breakouts, allergic reaction, or, rarely, more serious skin reactions. By booking and receiving a service, you acknowledge and voluntarily assume these risks.

Studio location and premises. Our studio is located on the lower level of a private residence in Eagle Mountain, Utah, and is accessed via stairs, including 3–4 steps at the entrance. The space is not wheelchair accessible. If you have mobility concerns or questions about whether the space will work for you, please contact us at jenny@myfaciallady.com before booking. We also offer a Virtual Consultation for facial services as an alternative for clients who are unable to access the in-person studio. Additionally, a dog and a cat reside in the home. They are not permitted in the treatment room, but if you have pet allergies or sensitivities, please notify us in advance so we can plan accordingly. By booking an appointment, you acknowledge these premises conditions and voluntarily assume any associated risk.

To the fullest extent permitted by Utah law, you release Skin Deep Esthetics and Wellness LLC, its owner, and its personnel from liability for injury, reaction, or damage arising from services rendered, except to the extent caused by our gross negligence or willful misconduct.

This general release is in addition to, and does not replace, any separate written Informed Consent / Waiver form you may be asked to sign before receiving certain services. Where a conflict exists between this section and a signed service-specific consent form, the more specific, signed consent form controls for that service.

7. Payment Terms

  • Online orders and service payments are processed through Stripe. In-person payments may be made by cash, Venmo, or card via a Square card reader.
  • Prices for services and products are subject to change without notice; the price in effect at the time of booking or purchase applies to that transaction.
  • Full payment is due at the time of service or purchase, unless a deposit or different arrangement is agreed to in advance.
  • We do not store your full payment card information; this is handled by our payment processors in accordance with their own security standards (PCI-DSS).

8. Retail Products

  • Retail products purchased online are fulfilled via drop-shipment directly by our supplier, Skin Script. Shipping times, tracking, and delivery are subject to Skin Script's and the shipping carrier's processes; risk of loss passes to you upon delivery to the carrier, except as otherwise required by law.
  • Product descriptions, images, and claims on the Site are provided for informational purposes. Skincare products sold on the Site are cosmetics; they are not intended to diagnose, treat, cure, or prevent any disease, and have not been evaluated by the Food and Drug Administration unless otherwise stated.
  • Returns and refunds on retail products are governed by our separate Return Policy, which is incorporated into these Terms by reference. As a general matter, we do not offer returns or refunds except where required by applicable law.

9. Third-Party Services

Our Site and business operations rely on third-party platforms, including Squarespace (website hosting), Acuity Scheduling (booking and intake), Stripe and Square (payment processing), and Skin Script (product fulfillment). We do not control, and are not responsible for, the acts, omissions, availability, or privacy/security practices of these third parties. Your use of these platforms may also be subject to their own terms of service.

10. Intellectual Property

All content on the Site — including text, graphics, logos, and images — is owned by or licensed to Skin Deep Esthetics and Wellness LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written consent, except for personal, non-commercial use.

11. Prohibited Conduct

You agree not to:

  • Provide false or fraudulent information when booking an appointment or making a purchase;
  • Use the Site for any unlawful purpose;
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Site or our booking/payment systems;
  • Harass, threaten, or behave abusively toward our staff.

We reserve the right to refuse service, cancel bookings, or bar any individual from the Site or our business for violation of these Terms.

12. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such disclaimers are limited or prohibited by applicable law.

PRODUCTS: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL RETAIL PRODUCTS ARE SOLD "AS IS," AND WE DISCLAIM ALL IMPLIED WARRANTIES WITH RESPECT TO PRODUCTS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow the exclusion of implied warranties in consumer transactions, so some or all of the above exclusions may not apply to you. This disclaimer does not limit the remedies we voluntarily offer for damaged, defective, or incorrect items under our Return Policy, or any rights you have under applicable law that cannot be waived.

13. Limitation of Liability

To the fullest extent permitted by Utah law, Skin Deep Esthetics and Wellness LLC's total liability to you for any claim arising out of or relating to these Terms, our services, or products shall not exceed the amount you paid to us for the specific service or product giving rise to the claim. In no event shall we be liable for indirect, incidental, consequential, special, or punitive damages.

Nothing in these Terms limits liability where such limitation is prohibited by law (for example, for gross negligence, willful misconduct, or as otherwise required by Utah consumer protection law).

14. Indemnification

You agree to indemnify and hold harmless Skin Deep Esthetics and Wellness LLC, its owner, and personnel from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Site or our services, or your provision of inaccurate intake information.

15. Dispute Resolution

If a dispute arises, you agree to first contact us at jenny@myfaciallady.com to attempt a good-faith, informal resolution before pursuing formal legal action. If the dispute is not resolved within 30 days, either party may pursue the matter in a court of competent jurisdiction located in Utah County, Utah, which the parties agree is the exclusive venue for any such action, except that either party may bring an individual claim in small claims court where the claim qualifies.

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Return Policy, and any signed service-specific consent/waiver forms, constitute the entire agreement between you and Skin Deep Esthetics and Wellness LLC regarding your use of the Site and our services, and supersede any prior agreements on the same subject.
